Sales & delivery conditions for buying spareparts for private customers.

 

1. General

1.1 These general terms and conditions of sale and delivery apply to all sales between Schou (hereinafter "seller") and a consumer (hereinafter "buyer"), to the extent that they are not expressly deviated from by other written agreement.


2. Offer & order confirmation

2.1 The seller's offer is valid for 2 days, unless otherwise separately agreed and confirmed in writing by the seller.

2.2 The seller is only obligated in accordance with the content of the order confirmation.


3. Prices & payment - Reservation of title

3.1 All sales are made at prices in Danish kroner which are valid on the delivery date. All prices are inclusive of VAT, public charges of any kind and packaging, but exclusive of transport. Prices in price tables are non-binding and can be changed at any time without notice.

3.2 Unless otherwise agreed, payment must be made in net cash at the latest upon delivery. If payment is not made by the due date, the seller has the right to cancel the purchase immediately and without further notice or to charge default interest at 2% per started month.

3.3 The title to the sold remains in all respects with the seller until the purchase price and all other costs of the purchase have been effectively paid by the buyer.


4. Seller's services

4.1 The seller's services only includes the goods and services specified in the order confirmation. The seller undertakes to deliver a service of usual good quality in terms of materials and processing.


5. Delivery time & place of the seller's delivery

5.1 All stated delivery times are given approximately and are non-binding, unless otherwise expressly agreed and confirmed in writing by the seller.

5.2 Responsibility for what is delivered will pass to the buyer when the goods have been delivered.


6. Right of withdrawal

6.1 The buyer has the right to withdraw from any purchase made on the seller's online store (right of withdrawal) in accordance with the provisions of Chapter 4 of the Consumer Contracts Act. However, the right of withdrawal does not apply to purchases of goods manufactured to the buyer's specifications.

6.2 If the customer wishes to exercise his right of withdrawal, the customer must notify the seller of this no later than 14 days after receiving the goods. Notification must be made to the seller's address at Nordager 31, 6000 Kolding or by e-mail to info@schou.com.

6.3 When the buyer has notified the seller that the buyer wishes to exercise his right of withdrawal, the buyer must deliver or send the goods to the seller's address at [insert address] no later than 14 days later. The buyer bears all costs in connection with returning the goods to the seller. When exercising the right of withdrawal, the item must be returned in original packaging and packed as on delivery.

6.4 When the buyer has informed the seller that the buyer wishes to exercise his right of withdrawal, the seller will repay without undue delay all sums received from the buyer. However, this assumes that the goods have been received by the seller, or that the buyer has presented documentation that the goods have been returned. To the extent that the value of the goods has been impaired as a result of other handling of the goods, than what is necessary to determine the nature, characteristics and way of functioning of the goods, an amount corresponding to the deterioration in value will be deducted from the refund from the seller. If the item is not returned in original packaging and packed as on delivery, costs incurred by the seller will as a result be deducted from the refund from the seller.


7. Delay

7.1 The buyer must immediately advertise in writing upon ascertaining a delay, as the buyer will otherwise lose any claim as a result of the delay. The buyer must also give the seller a reasonable period of at least 14 days to fulfill his obligations.

7.2 If the seller fails to deliver the goods within the additional deadline given by the buyer pursuant to section 7.1, the buyer is entitled to cancel the purchase by written notification to the seller. If the delay only applies to a part of a total delivery, the buyer can only cancel the purchase, as far as the part in question is concerned.
